Dangerous and unconstitutional “Red Flag” gun confiscation laws empower the government to seize firearms from law-abiding citizens based on unsubstantiated accusations—without due process, without evidence, and without a crime being committed.
While Texas does not have an official statewide “Extreme Risk Protection Order” on the books, Texas has red flag-style policies through the use of protective order laws, which allow judges to strip Texans of their gun rights without a criminal conviction or due process in certain cases.
The Veterans Administration (VA) has also been operating de facto red flag-style policies for years, stripping tens of thousands of veterans of their Second Amendment rights simply for being diagnosed with PTSD – or even for having assistance with their finances.
Many of these veterans have never been charged with a crime, never threatened anyone, and never had their cases reviewed by a judge, yet their names are dumped into the National Instant Criminal Background Check System (NICS) as prohibited persons.
The bottom line: Red Flag style laws don’t just violate the Second Amendment. They also trample on the Fourth and Fifth Amendments by stripping Texans of their rights without proper legal proceedings.
This is a direct attack on the core principles of liberty and justice!
That’s why Sen. Bryan Hughes and Rep. Briscoe Cain have introduced SB 1362 & HB 162 to ban Red Flag style laws in Texas.
This legislation goes even further by rejecting any federal money that incentivizes Red Flag-style laws, including the gun control money approved by John Cornyn and Joe Biden’s “Bipartisan Safer Communities Act” in 2022.
We cannot allow anti-gun bureaucrats or federal dollars to undermine our state’s commitment to the Constitution.
